Legal Question in Family Law in Kentucky

Adoption

I have not seen, heard or received any child support from my ex-husband in 2 1/2 years. He was not even there to complete the divorce (I had to hire a warning order attorney to try and locate him). I have just remarried and my husband wants to adopt my son. Can we do this without my ex's consent? Can I take away his parental rights? I have no idea how to contact him or his family (no family members live in Kentucky).

Re: Adoption

KY law allows you to claim ex has abandoned child

if your husband files to adopt. An Order terminating ex's rights would have to

be entered as part of the adoption proceedings.

Warning Order would likely have to be appointed re ex,

and Guardian ad Litem would probably be appointed for

child.
