What chance my husband and I have of obtaining custody of our grandson? He has lived with us full time for the past 7 months. Our granddaughter (10 months) lives with my husband's mother & father. Their mother takes drugs, has no vehicle & very seldom sees him. She has lived in 8 different places in 3 yrs, & has been evicted numerous times for not paying her rent. She hangs with a bad crowd, & there is no stability in her life. She may call once per week to talk to him, but most of the time it's every 2 weeks or more. She lives only 20 minutes away. She has not been to seen them since Christmas Eve, & it was 3 weeks before that that she last saw them. Their parents are separated, with their father wanting nothing to do with him or his sister. He is physically abusive & doesn't pay child support. My daughter has never tried to get a divorce or file for child support. Our grandkids have a very stable life right now, a nice home & everything they need. We have legal guardianship of our grandson. He is in daycare (we pay for it), & we provide all of his other needs. We want to get something in writing where his mother can't come get him & haul him off somewhere where it's not safe for him to be. Do we have a chance?

Contact a lawyer about proceeding against both parents. The Court's primary interest should be the "best interest of the child.

Your prospects are not bad if the situation is as you describe it.
