who has custody of a child born to a non-married couple in which the child has the father's last name but doesn't have anything to do with the child untill the child is almost 2

Since the father's name is on the birth certificate, he can require equal access to his child. Since there is no "custody' order of the court, he can show the cops the birth certificate and the police will allow him equal access to the child.
