Legal Question in Employment Law in Louisiana

I am a manager at a tuxedo rental business in Louisiana . My employer cannot tell me if i am salary exempt or non exempt. They told me to ask the person who does my taxes. He said i am non exempt but he is not sure. I've had to work over 80 hours on my biweekly pay base and have not recieved any compensation for this. Is this legal in the state of Louisiana. What should i do. Please help me.

"Exempt" or "non-exempt" refers to whether you are exempt from the overtime laws. If you are "exempt", your employer must pay you the exact same amount "regardless of the quantity or quality of your work." In other words, you are paid a salary and that is what you get whether you work 1 hour or 100 hours. If you get docked for missing work, you are not exempt and must be paid overtime anytime you work over 40 hours in a week. If your employer fails to do so, the employer is breaking the law.
