Tree on Property Line of myself and neighbor

I recently bought this house and on the property line is a crepe myrtle tree. Since it is on the property line can I have it cut down, not just a property cut. I have tried a property cut and have a mess all over. I have spent a fortune. Please help!

This issue is addressed in the Civil Code and you shouldn't have any problem finding it. Basically, as I remember, trees on the boundary line are joint responsibility and you can only trim your side, without killing the tree unless your neighbor agrees to remove it.
