Same attorney handling Estates

My dad suddenlty died a year ago. My stepmother was named executor of his Estate. Within three months after his death she committed suicide. To make a long story short a handwriting specialists has proved my stepmother was the one who forged my dad's name on his ''Will'' and as well forged my dad's name on an out-of-state ''marriage license'', which will prove they were never legally married. Dad's Estate attorney is the same attorney handling my stepmother's Estate in which her Estate has defrauded my dad's Estate. Is this legal? Please help!

I will not say that the attorney is doing anything improper because I have no information that supports that conclusion. In fact, even if his client, your stepmother, had no ethics at all, that says nothing about the lawyer. The circumstances may still create a conflict of interest for him.

I wll say that your father's heirs, out of an abundance of caution, could retain a different lawyer to handle his succession.
