Legal Question in Workers Comp in Maine

injury at work

I am being treated for torn knee cartlidge-need surgery-mri confirmed-I can't collect for pain and suffering in Maine? Injury was due to defective floor which should have been discovered and fixed, only the company has us initial/sign safety tour reports even though we never actually do these tours. Can they be sued for something civily due to their negligence resulting in my injury

Thank you for your inquiry. Without explaining the workers compensation system, suffice it to say that if only the employer is responsible for the injury, then you cannot collect for pain and suffering...the only compensation would be for medical expenses and lost wages. It is possible that another party may be responsible, in which event you may be able to collect for pain, suffering, loss of quality of life and permanent impairment, in addition to a portion of your lost wages that workers comp does not provide to you as a benefit.
