Legal Question in Credit and Debt Law in Maryland

Threatens not to pay car loan

I co-sigened on my exes car loan. We have a child together and it was been almost 2 years since he helped out with him. Now that I am asking for a little bit of money each month he says he cannot give me that much. So I told him we can just go to court but they are going to make him pay a lot more than I am asking for. So he tells me that if I take him to court for child support he will not pay his car loan and it will ruin my credit. Is there anything legal I can do? I know I cannot get out of the loan but I also need help with my son. I am stuck.

Re: Threatens not to pay car loan

Maybe you should point out that if he stops paying the car loan then he will have no car to drive because it will be repossessed. Or if he stops paying the car loan you will be happy to come get the car (assuming your name is on the title) and drive it yourself. Or you can tell him that you don't care if he ruins your credit because you'll just file a bankruptcy (even though you wouldn't). I'll bet he needs this car and will keep making the payments. Go to the Child Support Enforcement Office and sue him for child support. It's for your son and not for you. Unfortunately, there isn't much you can do to prevent him from following up on his threat and stop making the payments.
