Legal Question in Family Law in Maryland

Custody from another State

I am wanting to know what can i do about while i was on military duty overseas my childs biological father was given power of attorney. upon my returning i was given custody papers that stated that custody was granted while i was away. I would like to know how was that possible when there was no court apperance by me or i had no knowledge of anything. also there was nothing i could do about this. And this happened 7 years ago and to this day i have not recieved the first copy of any custody papers telling my restrictions what i can and cannot do. I am also paying child support. i am living in Alabama and everything that was legal was done in the state that my child and her biological father reside in, maryland. Thank-you.

Re: Custody from another State

You can get copies of court filing from the clerk of the circuit court in which the custody orders were entered. It seems incredible that in 7 years you never learned that the bio father had obtained custody. You should have been served with any petitions requesting custody at that time. Since you are in the military your whereabouts should have been known or discoverable. However, with this much time going by, it would be difficult to challenge custody now unless he is not doing a good job. But you certainly should be entitled to visitation and that should be provided for in the court papers.
