Fight for custody

Me fiance is incarcerated non-violent, 1st off. . His childs mother sent him forms for joint custody. Then she filed paperwork with the court for sole custody. She has a 4 yr. old that is not his but wants him to support her too. She is usin his criminal record in court. Recent incident at her house and police was called. Minors under the age of 10 were left unattended. She only lets him see the child when she tries to get back with my fiance,or wants to go out for the weekend. This is goin to be a battle. What should we do before the initial court date in March?

You need legal assistance, right away. If your fiance qualifies re income, you could contact your county bar association and ask about their pro bono (free) or reduced fee program for getting an attorney. He has no duty to support the 4 yr old if he hasn't been legally determined to be her father, but he will have to support his child. He can request joint legal custody, but it sounds like the mother will retain physical custody given his current situation.
