Legal Question in Civil Litigation in Maryland

Maryland Condominium Law

My OceanCityMD condo got severe water damage on two occasions from leaks in roof above my unit due to negligent maintenance by condo association. My unit was hit the worst and only 4 other (of 20) units were effected. Insurer rejected assocn claim due to poor maintenance. MDCondoLaw 1982/1997 Para 11-110 says Assocn responsible to get insurance for units and if insurance proceeeds are not sufficient to repair damages units then remaining costs are to be paid out of reserves or if reserves are not sufficient, remaining repair costs are to be treated as "common expenses" in which all unit owners share equally. I believe I should bear only 1/20th of the cost instead of 100%. Am I correct and where can I find case law cites on this problem?

You would have to look in the case law reporters--either the Maryland Reporter or the Atlantic Reporter--available in any law library--to find cases which discuss your issue. If you have already looked in an annotated code at the statute, names of cases that discuss that statute would appear and you can start there.
