Legal Question in Civil Litigation in Maryland

Right of witness

I am being summonsed as a witness by the defendants lawyer (who assulted my son). to testify against his character, i assume. I did not see the incident. Is this legal or can i get out of this?

I assume the defendant did the assault, not his lawyer...

In any event, the short answer is probably no. You have to appear in response to a valid subpoena, and give truthful testimony, unless the testimony is privileged. For a more detailed answer in response to your particular facts, you need to consult with a real live lawyer.
