Accident caused by my seventeen year son that does live in my housebut had permi

An accident was caused by my son who did not live in the house with me at the time on August 28, 2002. There were three cars involved, my car which was insured and he hit another car that hit another car. My car had no damage and the car in fornt of him had no damage. But the car in front of that car contacted her insurance company with monor damage and medical claim. At that time the her insurance company told me that they thoughtit was a fraud. My husband had sign a form with our insuranc company advising them that our son was not in the home and would not drive any vehicle which was signed on August 21, 2002. I was not aware of the signing of the form until after the accident, therfore when the lady's insurance company contacted my insurance company the denied the claim.

Now my son who does not live in this state anymore and I just received letters at my home address from the lady's insurance company legal department requesting a payment of $20,000. Which is alot for someone whose car only had minor damage. My car or the other car had no damage and she was in front of the middle car. What do I do? Is my insurance liable since my car was insured? Please advise me of what should be done. Thanks

You need to turn this claim over to your insurance company, which should handle it. It sounds like your insurance policy is the proper one to respond.

If your insurance company has declined coverage of the claim then you should obtain legal assistance. Coverage declination needs to be specific.

The named insured on the policy as well as the content of the form signed by your husband needs to be reviewed if you retrieved copies; your insurance policy should also be reviewed.

Where coverage is not available you should seek an attorney. Your defenses need to be presented. Delaying may cause further problems with your case as notice deadlines are soon approaching. As with most motor vehicle matters the key issues resolve around the facts of the collision.
