Is driver liable if his car killed my grandson in cross walk with no witnesses?

I am very sorry to hear about the loss of your grandson. I have worked on a few pedestrian accident cases and whether or not the driver will be ultimately responsible may depend on the specific circumstances (such as was the walk light on or not, was the driver going too fast or not paying attention or could have avoided the accident?) The lack of witnesses may complicate the case but does not automatically determine the outcome. Some factors like speed and direction can be determined by experts after-the-fact.

The lack of witnesses will make proving liability more difficult but the claim should certainly be pursued and the sooner the better. The Statute of Limitatons on Wrongful Death claims is between 1 and 3 years in the Maryland DC area and I agree with the attorney above who said you will need the help of a lawyer if for no other reason than to help you open an Estate.
