Legal Question in Personal Injury in Maryland

Home Association

I am a member of the home association, we want to purchase playground equipment from PlayNation for $13,000, they say they cannot warrant equipment if it is sold to home association but if they sell to a board member and that member gives it to association them they will warrant. question: can that board member be held responsible if their are any accidents or claims due to injuries? We do have insurance coverage on the complex which includes playbground. Thank you/

If the board member immediately transfers ownership of the equipment to the association, he can't be held liable for any accidents that occur thereafter. Also, the board could pass a resolution indemnifying the board member if he somehow were sued because of an accident. Frankly, the equipment company's policy doesn't make sense.
