Assuming the defendant was represented by his/her liability carrier and there are no post-trial motions or appeals, the insurance company usually issues a check within a week or so. They will send it to your attorney, who should then prepare a disbursement statement indicating how the proceeds will be distributed. This would include your attorney's fee and any advanced costs, any payments due to medical providers or other lienholders, including reimbursement for any bills paid by your health insurance or other coverage for which there is a repay requirement, and finally the balance to you. You should check with your attorney to see when they expect payment.
