Legal Question in Business Law in Massachusetts

Motion to quash?

I subpoena'd a partners bank records for a variety of reasons and now he has filed a motion to quash.

Do I need to submit anything to the court? or, do I just show up at the hearing and tell the judge why he should deny this motion?

Re: Motion to quash?

You should file an answer to his motion if you have one and argue your point of law as well as facts. I assume he has an attorney, you will be at a disadvantge and might want to hire an attorney at this stage.

good luck

Re: Motion to quash?

Absolutely. You should be ready with a motion in support of yours, and in opposition to the motion to quash, and in the alternative seek a court order to require the documents be presented to the court.
