Legal Question in Credit and Debt Law in Massachusetts

Hi,

I signed a contract with Royal Holiday. Before deposit was charged I called my cc company and was told i could not be charged because it was considered a defered payment. Royal Holiday not only lied to me about charging my account they also lied about the cancellation policy. I signed the contract thinking they put it under defered payment and not amount received. My credit card was charged. I am disputing this with my credit card. Can I hold them responsible for misrepresentation?? Also was wondering if I paid the 2,500 to the credit card company is the company (Royal Holiday) then allowed to charge the 225 monthly fee to my new credit card (canceled the other one after deposit went on it) which is a different # from my origianl contract that I signed. any info would be great. Can I have my contract recind where I was lied to according the civil code article 44

Without seeing the contract you signed I do not know if there was misrepresentation involved. If there was, report it to the Attorney General's Office and Better Business Bureau.

Your contract will determine whether you can rescind it and under what terms.

The cancellation policy in the written agreement will govern, even if someone told you (verbally) something else. Again, if this is a deceptive company report them to the authorities.

Also, if you believe that you did not properly authorize the company to withdraw the funds, then contact your bank and report an unauthorized withdrawal.

The written documents in this case are what is key to sort out the problem.
