drug charges

Last night my boyfriend had a bad

trip on shrooms and 911 needed to

be contacted. The police came to my

apartment and told me that i would

be arrested if i denied them the right

to search it. They found less than 1/8

of weed and shrooms plus a bong,

scale, and grinder. they left without

charging anything but said that we

would be summoned to court. what

will happen?

It depends on the charges, if any. It depends on the records of the person who is being charged.

You should talk to no one, and certainly not post a detailed description on the internet.

You will likely receive the summons from the police to come to court for an arraignment. If you cannot afford an attorney, one will be provided to you at the time of your arraignment. If the court does not give you an attorney, or you don't want a court assigned attorney, it would almost certainly be advisable for you to hire one yourself. In cases involving the seizure of drugs in a home, there are a number of issues that often come up. Was the search of the home lawful? In your case, their is a question as to whether the search was performed based on your consent. These issues are presented to the court before trial. If the search was unlawful, the drugs and paraphernalia can be suppressed (excluded) and this can lead to the charges being dismissed. There are also often issues regarding who owned the drugs, whether they were possessed with "intent to distribute."
