divorce

i have been married for 36 years. a couple of months ago i found out my husband has a girlfriend. so i left the house to stay with my daughter. what are my rights for the little property we have jointly?

not a home but the everyday stuff you collect together over the years. he refuses to give me some things (one of the two cars) because i left him.

divorce and rights

When you file for divorce, you are entitled to an equitable division of assets and liabilities. You may also be entitled to alimony, and coverage for medical insurance. You should file for divorce, if you intend to, as soon as possible. THis will preserve your rights, and there will also be an order that preserves either party from expanding assets, and creating liabilities.

You are entitled to an equitable division of the assets and you may also be entitled to alimony.

If you are not ready to file for divorce you could file for separate support (it is similar to a legal separation). However, in Massachusetts they call it separate support.

Once you file and the parties are served there is a restraining order on the assets (meaning no one can dissipate the assets without the other's permission.
