Legal Question in Employment Law in Massachusetts

Can employers impose a surcharge for health insurance? For example, a woman's husband is working for a different company and can obtain health insurance from that company but opts instead to be insured through the wife's company. Can the wife's company impose the surcharge for the wife purchasing insurance also for her husband.

The short answer is that you may want to look more closely at the specific documents regarding your wife's insurance coverage. However if a family plan of some sort is available, then the company should not be adding a surcharge to those who elect to use it.

Good luck and I hope that helps. Take care.
