Legal Question in Employment Law in Massachusetts

Slander and defamation of character

My son was working at a house with several others in the construction trade (HVAC) about a month ago. About a week later, the owner said that something was stolen. Police investigated and questioned everyone that had been there over the past few weeks. My son could account for his time and was told he was no longer a suspect. Two days later, the company fired him for being 10 minutes late.

He got another job two weeks ago. That company called for references and the owner of the first company said ''Don't hire him, he is a thief''. The second company then terminated him as he told him he couldn't employ someone that was even suspected of being a thief. He has tried to state his case and even offered for his boss to talk to the investigating officer. So far no luck.

It appears as though he has little chance of getting his job back. The second issue is obviously the fact that his prior boss made unfounded and unproven accusations which cost him his job. The ultimate goal is to get employed again ... and to prevent this guy from costing him future jobs, but there's not a lot of companies near by that do this and word gets around. Where do we go from here?

Re: Slander and defamation of character

I am sorry to hear about your son's ordeal. To answer your questions, I would need additional information. Is your son a minor? Was your son advised by the prosepective employer that he was not being hired due to allegations made by the former employer that he was a "thief"? These and other questions need to be answered. Please feel free to call my office for a free legal consultation if your son would like to explore taking possible legal action. We would be more than happy to assist.
