Legal Question in Employment Law in Massachusetts

Work Suspension

I was recently told I was suspended without pay. I was told that the company would get in touch with me in four days and set up an appointment for me to come in and discuss matterswithin a two day time frame. They waited a week and a half to get in touch with me and are now setting up a meeting in nine days. This situation and treatment is not warranted.

In the meantime, I can't collect unemployment. I have no money coming in. Can this company just keep me in limbo? Is there anyway that I can just resign and collect unemployment?

Re: Work Suspension

As an at will employee, you can be terminated at any time for any reason or no reason at all. That they suspended you without pay and have taken a long time to get back in touch with you is not unlawful per se. Whether you can collect unemployment depends on the reasons for your termination (or your resigning) which is not mentioned in your posting. For example, if you were suspended and you ultimately resigned over what the company perceives as a violation of a uniformly enforced company policy, you're not going to be able to collect unemployment.
