Legal Question in Employment Law in Massachusetts

Workplace Violence

In January of 2002 I was raped at my place of work by a customer after closing. My question is one of responsibility. I was the only employee in a high crime area at night , several of the stores in the metro area owned by my company had been robbed recently. There wasnt adequate security i.e. cameras, alarms, etc. Are they negligent and could I persue a claim against my company?

Re: Workplace Violence

I am sorry to hear of this horrendous event. In my view, it is likely that you have a cause of action against your employer. It does depend on numerous factors, but leaving an employee alone in a high crime area with no security may very well be considered negligent. I would be happy to talk to you about this matter, and help in any way I can.

Re: Workplace Violence

I am so sorry for the cruelty inflicted on you and hope that you will take advantage of the healing and support services that are available to you in the community. YOu are not alone.

You most certainly can pursue both your employer and the customer as well as the landlord/owner of the premises. Make sure you haved reported to police. Hopefully you reported to hospital and asked them to use the rape kit to preserve evidence.

Re: Workplace Violence

Possibly.

But without more; one cannot address your question fairly.
