Legal Question in Medical Malpractice in Massachusetts

injury due to negligent physical therapist

Would a visiting home physical therapist be liable for causing me to fall due to an exercise that was not appropriate for me? I am a 72 year old woman with weak legs and this fall has set me back a year due to this therapist. Is there any legal action I can take against her?

Re: injury due to negligent physical therapist

While the answer to your question requires additional facts, from your description alone the answer is likely, "yes." Visiting physical therapists owe a duty of care and, depending on the circumstances of the incident, can be (and/or their employer can be) held liable if they contributed to or caused your injury. Probably the therapist's employer carries insurance to cover such claims, and a claim would be made against that insurance carrier if the grounds were solid.
