Legal Question in Personal Injury in Massachusetts

pet sore accident

today while shopping in a major pet store chain with my husband and 2 young boys, we were looking at the fish and my son 3 yr old son was walking up to me, he slipped on a wet floor in front of one of the tanks and sustained a bloody fat lip and a swollen red cheeck not my son wants nothing to do with fish or a pet store, what are my options?

Get some medical treatment and see what the doctor says. If your son is going to fully recover your legal options are not going to be worth exercising. If you don't have health insurance, which is pretty difficult to fathom with the mandatory health insurance law, then you might ask the store to cover the medical bill. Most stores like this have first party medical payments. Unfortunately a swollen lip is too small an injury to seek redress in the civil justice system. If your son had some number of stiches and a permanent scar, then it might be worthwhile to consider whether the store was negligent. If the water just spilled, it might not be; if the store knew or should have known there was spilled water and did act with sufficient alarm then that might be the makings of a negligence claim. Personal Injury , Slip and Fall, Premises Liability - Massachusetts (MA)

You may be able to pursue a Personal Injury case as a result of the slip and fall. However, it does not appear that the damages warrant filing a claim. In order to pursue a slip and fall claim you must prove that the store was negligent and the store's negligence caused the accident. In other words the store must be at fault for the accident.
