Legal Question in Personal Injury in Massachusetts

Recently I had a mass of ice fall from the apartment building I rent from and casue damage to my automobile. I ended up filing a claim with my insurance company assuming that they would go after the home owners insurance of my landlord but was told that 9/10 times I would not be able to obtain any money from my landlord for the damges causes to my car due to the fact that I could not prove negligence on his part. Is this true?

I would like to try to obtain atleast the deductable of my car insurance from my landlord.

Make a demand on the landlord for the amount of your deductible. If they don't pay then file a claim in small claims court.
