Legal Question in Personal Injury in Massachusetts

Wrist injury

I had an operation on a tendon in my wrist about 1 1/2 years ago which was succesful. the wrist had healed great. In November 2002 someone came to my home, forced her way in and in the struggle my wrist was re-injured. I was awarded a restraining order but was not able to file assault charges, they were denied in court. Can I now sue this person ? If yes what is my first step as far as getting the case going? Most personal injury lawyers seem to only deal with insurance companies.

Yes, you certainly can sue. The question is, is it worthwhile to do so.

If the person who assaulted you owned a house, then it is worthwhile to sue. Assuming you allege negligence her homeowner's coverage will pay any judgment.

If she does not own a house, you need to see if she will have the assets to pay a judgment. Does she have a good job? What are her assets? If she has nothing, you will get nothing for your troubles.
