Legal Question in Consumer Law in Michigan

Collecting Bill from years ago

I recevived a bill from a collection agency representing a large utility company whom merged with another utility company I delt with prior to 2001. Now they are trying to collect a bill that the old company dismissed and I never heard from again till now. I no longer have proof as it has been several years and have discarded it due to no contact from that company over the years. Who do I contact to fight this. The person at the collection agency threatened if we don't pay right away they will take action.

Re: Collecting Bill from years ago

You don't say why the bill was "dismissed." If you mean the utility company did not pursue collection, you are still obligated to pay it. If you disputed the bill and the utility company agreed you did not have to pay it, you must also dispute it with the new company.

A collection agency cannot threaten to sue you or take any action against you such as garnish your wages or take your property. If they do so, they violate the Fair Debt Collection Practices Act and you may be entitled to money damages. You would need proof such as a tape-recorded telephone conversation or written correspondence. For more information, you can contact my office.
