Legal Question in Credit and Debt Law in Michigan

I have been served papers on a old debt. The papers say that they representing the Credit Card company. However later in the document it says that they bought the debt from the Credit Card Company. Is that legal for them to misrepresent themselves in legal forms? What can I do about being served?

This is not a misrepresentation. It is an accurate statement. When someone purchases a debt, they now become the owner of it and represent that interest. As to being served, you need to file a written answer with the court and mail a copy of your response to the attorney. If you want to put up a strong defense, I would suggest hiring an attorney such as myself that handles these types of cases on a daily basis.

If they purchased the debt, they should be suing in their own name. I would need to see the papers to figure out exactly what is going on. If you were personally served, you have 21 days to file an answer. If you would like to talk about this more, visit our website at www.aldrichlegalservices.com, and give us a call.
