Legal Question in Family Law in Michigan

divorce

I have been married less than 2 years. I am planning to get a divorce. I have worked full time for the last year earning 31,000. My husband has been unemployed earning 5,000 on unemployment benefits. I am planning to buy a house for my children and I (not his). Can I buy this house before filing the divorce without it getting divided as marital property? I live in Michigan.

Re: divorce

Since the funds that you would use to buy the house have been there prior to the divorce, those funds would be marital assets. Therefore, the funds used to buy the house came from assets that you had while you were married. Those are the same funds that you had before that he would potentially be entitled to. However, these are issues that you should take up with a divorce lawyer representing you. William S. Stern
