Re: Land

The answer to your question is it depends. I would need a few more facts pertaining to your property - for instance, did you build a house on this land during your marriage? Was there a house on the property, and If so, did you and your spouse live in it? or, was this just a piece of vacant land you bought on speculation prior to your marriage in hopes that it would apprecriate? Depending on your response to these questions, the answer could be different. If you would like more information do not hesitate to contact me directly at (734) 944-2269.

Kindest Regards,

Re: Land

Hello, I have received a copy or your question regarding the property you purchased before your marriage. The general rule is that assets purchased prior to marriage stay the property of that individual. However, you must keep in mind that it is the duty of the divorce court to divide assets in a "fair" way. Therefore, sometimes a non-marital asset (or something of comparable value)is given to the other party in order to reach a "fair" result. The other thing to remember is that is "marital" assets are used to improve that property or that property is used in such a way as to benefit the whole family, it can sometimes be considered a "marital" asset.
