What permission(s) do I need from my baby's father to change her last name?

My daughter was born out of wedlock and I (stupidly) gave her the last name of her father. Now I am married, have another baby on the way, and really want her to have the same last name as ''the rest of us.'' Does her father have to 'OK' my plan... and what if he Won't? We do not have court ordered visitations set up, he sees her a few days a week.

To Whom It May Concern:

This is in response to your email submitted on February 7, 2001, which we received on March 21, 2001.

To change your child�s last name, you can file a petition with the probate court in the county in which you live. You will have to give the father notice of the hearing. However, if he does not object or show up, the petition will be granted. Even if he objects, your petition may still be granted. In any case, you may need to retain an attorney to get this accomplished.
