awol

i went awol in the beginning of this month. i was in ait so my time enlisted was less than six months. i need to know if i get arrested by a civilian police officer how much time will i do in jail. i failed every pt test including the one from basic training they ''pushed'' me through

Please don't look at your problem as simply "how much jail time" will you do. You need to resolve this issue once and for all and get on with your life. Once you have been AWOL for 30 days, you are placed into "Deserter" status, and an arrest warrant is generated and placed into the FBI's national computer system. Any police officer is then authorized to arrest you - you will be placed into the local jail until someone comes and "escorts" you back to your military's deserter unit or in your case, perhaps AIT. The military can continue to keep you in custody and court-martial you - there are many factors involved.

If the 30 days have not yet expired, I urge you to surrender to the closest military unit to where ever you are in Michigan - even your Recruiter's office will work.

You are entitled to a lawyer, a military defense lawyer [like a public defender] will be appointed to represent you IF YOU ASK FOR ONE!
