Legal Question in Wills and Trusts in Michigan

I just discovered the attorney who prepared my Revocable Trust has been deceased 5-6 years. My question is will my original copy be sufficient for my family to dispose of my estate? Also, do attorneys register these documents at the County office? Thank you.

Yes, your original Trust will be sufficient for your family to take care of your assets. I would request your entire file from the law firm, or from whoever took over the law firm, so that you have your file and can turn it over to another attorney (or have it updated as needed). Your Trust will not be registered with the County Probate Court, most trusts are not unless they are involved in a dispute. Also, if it has been 5 or 6 years, you should have your Trust and related plan (power of attorney, health care power, etc.) reviewed to make sure it still meets your needs. Good luck.

When you say "original copy", do you mean original or copy? This makes a big difference. Most trust attorneys don't keep originals unless they are the nominated trustee. Tim Klisz
