Guardian needing help in process of leasing property.

I am the guardian of a deceased which had a dwelling which is paid for in full and which I have been paying the taxes on for the last year.How would I go about putting the dwelling in my name so that I may get a loan to fix up the place and lease it out?

Whoa Nellie! You cannot get the house in your name unless it was given to you in a will, in which case it has to be probated; or, if there is no will, you would have to be an heir at law, entitled to inherit, but there is still a probate proceeding; or your name has to be on the deed with your ward, in which case you will own it by operation of law, by filing a death certificate in the county where the property is located.

If none of the above apply, you should still be able to get reimbursed for your out of pocket costs, e.g. taxes, once an estate is opened.
