Legal Question in Wills and Trusts in Michigan

Time frame for filing papers for mediation

It has been 6 weeks since a judge said we have to go to mediation for my mothers estate(there was not enough to put it in probate)and their attn still has not filed any papers so we can get a date. Some of us live on the west coast and not knowing when we would have to show up is a real problem. How long can he drag out not filing papers with the court before our attn can do something about it. Thank you in advance for your help.

Re: Time frame for filing papers for mediation

You need an order submitting the case to the mediation tribunal or the mediation clerk. That order must be delivered to the mediation clerk who then sets the date. Bill Stern

Did you say you had an attorney? If so, he can petition the court to compel the estate's atty to participate in mediation, if that is what was ordered by the judge. For more info, please contact my office at (248)851-3171.
