Legal Question in Wills and Trusts in Michigan

Time limit for creditors to demand payment from estate.

Our father passed away September 2003. Everything went to estate no will was probated. His land had been forclosed on prior to his death. Received a invoice for a propane tank that had been on his land but we had no knowledge of or had we received a invoice until this week, a year after his death. My question - is there a time limit in which creditors may file claims against the estate.

Yes, is the probate estate closed? If so, the creditors are probably out of luck. Even so, are there estate assets for creditors to attach? For more info, please contact my office at (248)851-3171.

Well first, if there were no probate assets then the creditors are out of luck. If there WERE probate assets, then creditors have a time period to raise claims after Notice to Creditors is published in the county in which the decedent passed away. Need clarity? Call me - 248.569.1900.
