Legal Question in Criminal Law in Minnesota

break the rules of probation in Minnesota

My neice have a warrant for her arrest. She been convicted of 5th assault. She like to get the matter resolve without going to jail. Me and her plan on moving out of town by the middle of Nov. She never been in trouble with the law. I told her it wil be hard for you to get housing, some jobs, by it becoming public records. She only have a couple of months of probation and broke it due to mentally and personal issue. The psychologist she pose to see wasn't helping her with her problems. He did most of the talking and she felt like she wasting her time.

Re: break the rules of probation in Minnesota

She should discuss this with her lawyer. Normally, she will have to be processed through the jail, then see the sentencing judge, if there is an arrest & detain order for an alleged probation violation. Her lawyer can help ensure the briefest amount of time in jail. If she isn't happy with conditions of probation, such as a certain psychologist, she should discuss this with her lawyer and-or probation officer, not just violate the probation condition. If she already has violated, her lawyer can help her present her case to the court in the most effective way. Good luck.
