Legal Question in Family Law in Minnesota

Can a parent claim a child on taxes of they only visited for about 2 months? If that parent does claim the child what can be done about it?

The answer to this quesiton involves the federal tax laws. If an order is not in place addressing who should get the dependent tax exemption, then you should check with your tax preparer. The exemption is not based upon visitation.

The answer depends on your court order and what it provides. if the court order is silent, under tax law, the parent that provided greater than fifty percent (50%) of the child's care in a given year may claim the child.
