Legal Question in Real Estate Law in Minnesota

How to move a school bus stop...

I have owned a home for two years that is being used as a school bus stop. After putting up with constant trespassing and minor damage to my yard I have finally decided that I don't want to allow this to continue. My initial contact with the bus company resulted in nothing more than denial and a statement that the company would involve the principal of the school and the police in ''educating'' the children about responsible behavior on private property.

I simply want the bus stop moved...period. What are my rights and how can I convince the bus company to relocate the stop? I am also concerned about liability if one of the little urchins slips on an icy sidewalk and cracks his little head open. Help?

Re: How to move a school bus stop...

Much depends on whether the bus stop is on the right-of-way (which I suspect that it is). If so, you probably can't compel them to move it. If it is not on the right-of-way, you can persue the matter as a tresspass with the police and courts.

More practically, I suggest you deal directly with the school rather than the bus company. The school has great influence over bus operations. If the school official in charge of bus transportation is not of help, try to get on the school-board agenda. The more it can be accuratly portrayed as a safety issue rather than an inconvenience to you will likely influence the responsiveness of the school.
