Legal Question in Wills and Trusts in Minnesota

Personal Representative Fee Amount

For a gross estate of $1 million - what is a reasonable or typical Personal Representative Fee? Estate is 22 beneficiaries (mostly non-profits), no real estate but stocks, bonds, IRAs, annunities. Estate is the beneficiary, no PR fee amount defined in will for the PR. Simple estate/probate so no attorney but tax accountant involved.

Re: Personal Representative Fee Amount

I have seen personal representatives charge anywhere between $25 to $50 per hour, and nobody seems to complain. Of course, almost all the work I do is unsupervised, so the court is not being asked to approve anything. There was case law a long time ago stating that it is unethical for lawyers to charge a percentage of the estate. Legal fees have to be based on actual time spent. I am sure that PR fees would be treated the same way.

One measure of what's reasonable would be how much you are paid for your time at your place of employment. You should at least be able to get that. It is important for you to be keeping track of your time and your expenses. You should have detailed written records.

One more thing. If you don't have a lawyer, you should at least consult one. Sounds like you can afford it.
