Legal Question in Family Law in Mississippi

Divorce

I was married in Louisiana in 1984. I currently stay in Mississippi and my wife lives in Louisiana.

Q. Which state has jurisdiction over the divorce.

Re: Divorce

In Mississippi, one of the parties has to have been a bona fide (actual and for true) resident of Mississippi for 6 months before the Complaint for divorce is filed.

I do not know the requirements of Louisiana, but my guess is that she can get jurisdiction in Louisiana.

So the answer may well be both states.

Re: Divorce

If you have lived in Mississippi six months or longer, you may file in the county of your residence and have her served in Louisiana. It is also very possible, that she could also file in Louisiana, if she has met the residency requirement. So likely, both states could exercise jurisdiction.
