Legal Question in Employment Law in Mississippi

Labor Law for Salaried Employees

I live in the state of Mississippi. Does being a salaried employee give the employer the right to demand that after working 12 hours in one day that you continue to work another 8 hours. Making your work day a total of 20 hours. Can they demand this daily?

Re: Labor Law for Salaried Employees

A fact which surprises many employers is that simply paying an employee on a salary basis does not mean that you do not have to pay the employee overtime. If you are legitimately an exempt employee, then your employer can demand that you work 20 hour days for as long as you continue to work there. If you are not legitimately an exempt employee, your employer can still demand that you work the same hours, but they have to pay you the overtime premium for the work which you perform.

The short answer to your question is yes they can demand the work, but they may have to pay you extra for it.

If you would like some more information about whether you are legitimately exempt, you can email me at [email protected]. Thank you.
