Legal Question in Family Law in Missouri

I recently got my cousin involved in some of my problems with being pregnant and being a single mom. The father is in prison until 2 weeks before my due date. I agreed to allow her to adopt and she had gotten a lawyer. I have never met the lawyer nor have I ever seen or signed any papers. I backed out of the adoption with her and now she is threatening to take me to court, but i never signed anything. They technically cant do anything to me right? Also, I mentioned the father because hes been in prison the entire time Ive been pregnant and hes refusing to let me adopt. But he is very much incapable of raising our baby. Is there some sort of loop hole to have my son be adopted by a good family without his consent?

Until the father's parental rights have been termianted. No Missouri judge will grant an adoption Petition. Being incarcerated, is not evidence of neglect.

Be careful, about pushing the need for the adoption, you may deem your self unfit, lose custody of the child. You cousin could get custody, leaving you and the father paying child support to her.

It is illegal to sell a child. Therefore, your cousin may hav elittel legal avenues to pursue other than trying to get custody, until the father's rights can be dealt with. Unless you defrauded yrou cousin out of some money in the negotiations, it is unlikely that her attorney will even try to file suit against you, beyond covering their fee. If any deals were presented to you, you should consult direclty with a civil practice attorney in your area.
