Unmarried partner want an Eviction

My partner and I've been together for over 18 years. In this relationship we have two children, 14 and 19 years of age. I consider the relation over and for a year have asked my partner to leave. He has refused to go and has made threats against my wellfare. I own the house we live in. He was not responsible for any of the legal matters in obtaining my home. What are my rights on asking for his removal from my house.

If you are the sole owner of the home, your unmarried partner is in the same shoes as any tenant in a landlord-tenant relationship. Assuming you and your partner have not entered into a written lease agreement, your partner would either be a "tenant at will" or a month-to-month tenant. In either case, the law imposes, at a minimum, certain notice requirements to bring the tenancy to an end (typically, 30 days written notice to leave). You should consult with a local attorney for advice on this before taking any action on your own. One important issue that you may not have considered is what will happen with the children (in spite of their advanced age). If they are unemancipated (i.e., still at home, unmarried and going to school), you may be entitled to child support and help with college expenses if they stay with you.
