Legal Question in Employment Law in Missouri

The company I worked for laid me off due to the economy/cutbacks and said the position will be eliminated. That was less than 8 months ago, now I see the company advertising to hire in the position that I once held.

I sent them my resume.

My question is, are they obligated to rehire me? And if they are and don't, what legel action can I take if any.

Missouri is an at will employment state. Unless you have an employment contract, you are not required to keep working for a company, and they are not required to keep employing you. If they lay you off and later decide to refill your position, they are not required to rehire you. They can replace you, unless they do so because you are a member of aprotected group.
