Legal Question in Real Estate Law in Missouri

Property Ownership And Marriage

I have been married 3 years.

My wife has owned the property we live on for 15 years.

We have not changed the title deed to include my name.

What if she passed away without my name being on the title; would I have any ownship rights?

Re: Property Ownership And Marriage

The property would pass through your wife's will, or through probate if she doesn't have a will, unless she has executed a "beneficiary deed". You would have certain statutory rights under the probate law, but in all likelihood the property would be sold. It would be advisable for your wife to take some relatively simple and inexpensive action now to avoid this property having to go through probate at the time of her death.
