There is little that prevents an officer from pulling someone over, except that the driver refuses to stop. The rela question is can a speeding charge stick? You mentioned that there was an improperly marked work zone. An enhanced speeding tiocket may be sucessfully defended, in such a case. If the driver is accused of something else, like drug possession, the appropriateness of the traffic stop can come into play. But, I have not heard of a speeding ticket being resolved, by proving that the stop was for speeding in work zone, where the work zone was not properly marked. Theoretically, it could occur, but most defendants do not opt to spend the legal fees when they are several times the cost of a speeding ticket. If you need representation on a speeding ticket, you may email me.

Good luck
