It is not "illegal" to draft your own will. No one has goen to jail for writing their own will. But that is almost irrelevent. The questions is "will my Will be effective?" meaning, will it do with your property what you want done? That is the reason that most people have an attorney oversee the drafting and execution (signing and witnessing) of their will.

You can write your own will. If it is well wrtitten and executed correctly, then it will distribute your property as you wish. If it is incorrect in the drafting or execution, then it could prove to be a worthless piece of paper.

Good luck

I definitely advise everyone I speak with about this topic to spend the money to have an attorney prepare a Last Will and Testament. I have personally seen a good number of Wills prepared by persons who were not lawyers, sometimes using forms they purchased or found on the Internet, and these Wills would not be legally effective. Most attorneys can and will draft a proper Last Will adn Testament for a modest fee, sometimes as low as $150 to $300.
